1. Who we are and who these terms are for

re-stream.pro is provided by Big Small TV Ltd, a company registered in England and Wales (company number 05808692) whose registered office is at Studio G, L and 33, Trinity Buoy Wharf, London E14 0FN (“we”, “us”). You can contact us at restreampro@bigsmall.tv.

re-stream.pro is a service for businesses. By creating an account or making a booking you confirm that you are acting for a business, organisation or as a professional, not as a consumer, and that you can accept these terms on behalf of the organisation you represent (“you”).

2. What you are buying

A pass gives you your own streaming server (and, for re-stream pro, a Pro engine) for a booking period of 24 hours (day passes) or 7 days (week passes), starting at the time you choose. Each pass includes:

• Streams: the number of destinations (for example YouTube, Vimeo, Facebook) that can be live at the same time.
• Hours: the total streaming time included, counted while at least one destination is live.
• For re-stream pro: channels, the media library, timed cues and the face and speaker-following 9:16 feed.

Your server is normally ready about 20 minutes before the booking starts. It may go to sleep when nothing has been happening for a while to save energy; you can wake it from your account page and it is usually back within two minutes. Please wake it in good time before you go live.

3. Prices and payment

Prices are shown on our website in pounds sterling and exclude VAT, which is added at the applicable rate. You pay in full when you book, by card through our payment provider Stripe. A VAT receipt is emailed to you. We may offer promotion codes; each can be used only as described when it is issued. We can invoice approved business customers instead of taking card payment; invoices are payable within [14] days.

4. Changing or cancelling a booking

[Suggested policy, for Big Small to confirm:] You can cancel a booking from your account or by emailing us. If you cancel more than 7 days before the start, we refund the full price. If you cancel between 7 days and 48 hours before the start, we refund 50%. We cannot refund cancellations made less than 48 hours before the start or after the booking has started. We will move a booking to a new date free of charge once, if you ask at least 48 hours before the original start.

If we cannot provide your server for the booking period because of a fault on our side, we will refund the price of the pass in full.

5. Using your allowance

When you have used 80% of your hours we will warn you in the panel and by email. When the hours are used up, you will not be able to start new destinations, but we will not cut off a destination that is already live: it can carry on until it is stopped. At the end of the booking period, destinations that are live may continue for up to [2] hours so that a show can finish; after that the server is stopped. You can buy another pass at any time.

6. After your booking

Your server, its settings, show reports and any media you uploaded are kept for 7 days after the booking period ends, so that you can download reports, and are then permanently deleted. Please keep your own copies of anything you need.

7. Your content and responsibilities

• You keep all rights in the video, audio, graphics and other material you send through or upload to re-stream.pro (“your content”). You allow us to store, process and transmit your content only as needed to provide the service to you.
• You are responsible for having all rights, licences and permissions needed for your content and for sending it to the destinations you choose, including music, sports, event and performer rights, and for following the rules of each platform you stream to.
• You must not use re-stream.pro for content that is unlawful, infringes anyone's rights, is defamatory, hateful or harmful, or for spam, to attack other systems, or to stream to destinations you are not authorised to use.
• You are responsible for keeping your password, stream keys and API tokens safe and for everything done using your account. Tell us at once if you think someone else has access.

We may suspend a server or account if we reasonably believe these rules are being broken or that it is necessary to protect the service or others. Where we can, we will tell you first.

8. Availability and support

We work hard to keep re-stream.pro reliable, and every customer has their own server, but live streaming depends on networks, encoders, venues and third-party platforms outside our control. We do not promise that the service will be uninterrupted or error-free, or that any platform will accept or display your stream. For important shows we recommend using a backup input and testing your set-up before you go live. 9. Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for loss of profits, revenue, business, sponsorship, audience or goodwill, for costs of crew, venues or broadcast slots, or for any indirect or consequential loss. Our total liability to you for any booking is limited to the price you paid for that booking [or, if greater, £[amount]].

10. Personal data

Our privacy notice explains how we use personal data about you and your team. Where your content or show reports contain personal data about other people, you are the controller of that data and we process it on your behalf only to provide the service; our data processing terms [link / available on request] apply.

11. Our software

re-stream.pro, its panel, apps and documentation belong to us or our licensors. You may use them only to use the service during your bookings. If you give us suggestions, we may use them freely.

12. Changes to these terms

We may update these terms from time to time. The version in force when you make a booking applies to that booking.

13. General

These terms are the whole agreement between you and us about re-stream.pro. Neither of us is responsible for delays or failures caused by events beyond our reasonable control. You may not transfer your rights under these terms without our consent. If any part of these terms is found to be unenforceable, the rest remains in force. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
